Waverii does not own, operate, or control any services listed on the platform.
By accessing or using Waverii, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

1. Definitions
- “Waverii” refers to the marketplace platform, including the website and related services.
- “Service Seeker” refers to any user booking or engaging services through the platform.
- “Service Provider” refers to any individual or business offering services on Waverii.
- “User” refers to both Service Seekers and Service Providers.
- “Content” refers to any text, images, videos, or materials posted on the platform.
- “Services” refers to any surf-related or travel-related offerings listed on Waverii.
2. Agreement to Terms
- By using the platform, you confirm that you have the legal authority to enter into this agreement and agree to comply with all applicable laws.
- You must be at least 18 years old or the legal age in your jurisdiction.
- Waverii may suspend or terminate access to the platform for violations of these Terms.
3. Platform Role
- Waverii is a neutral marketplace that connects Service Seekers with independent Service Providers.
- Waverii acts solely as a technology platform for discovery and does not provide, manage, or control any services listed on the platform.
- All services are provided by independent third-party providers. Waverii is not a party to any agreement between users.
4. No Agency Clause
Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between Waverii and any service provider.
5. Payments & Transactions
- Payments are processed through third-party providers (such as Stripe Connect). Waverii facilitates payment connections but does not hold funds, process payments directly, or assume responsibility for transactions, disputes, or chargebacks.
- Service Providers are solely responsible for their pricing, policies, and transaction terms.
- Waverii is not a financial institution and does not provide payment services.
6. User Responsibilities
Users agree to:
- Provide accurate and up-to-date information
- Comply with all applicable laws and regulations
- Communicate honestly and professionally
- Respect other users and local communities
Service Providers are solely responsible for the services they offer, including safety, legality, and quality.
7. Risk Acknowledgment
- Surfing and travel activities involve inherent risks, including injury, loss, or death.
- By using Waverii, you acknowledge and assume all risks associated with participating in any services.
- Waverii is not liable for any injuries, damages, or losses arising from services booked through the platform.
8. User Conduct
Users agree not to:
- Use the platform for unlawful, fraudulent, or harmful purposes
- Post false, misleading, or infringing content
- Harass, threaten, or discriminate against others
- Interfere with the operation or security of the platform
Waverii reserves the right to remove content or suspend accounts that violate these Terms.
9. Intellectual Property
Users retain ownership of the content they post.
By posting content on Waverii, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and promote that content in connection with the platform.
Users are responsible for ensuring their content does not violate third-party rights.
10. Privacy
Waverii processes personal data in accordance with its Privacy Policy.
By using the platform, you consent to such processing, including international data transfers where applicable.
11. Service Provider Responsibilities
Service Providers are solely responsible for:
- The accuracy of their listings
- The delivery and quality of their services
- Compliance with all applicable laws, permits, and regulations
- Managing cancellations, refunds, and disputes
Waverii does not verify, guarantee, or assume responsibility for the legality, safety, or quality of any services.
12. Service Seeker Responsibilities
Service Seekers are responsible for:
- Reviewing listings and service details before booking
- Communicating directly with Service Providers
- Understanding and agreeing to provider policies
Waverii is not responsible for user decisions, interactions, or outcomes resulting from services.
13. Disputes
All disputes must be resolved solely and directly between the Service Seeker and Service Provider. Waverii does not mediate, resolve, or assume liability for any disputes, claims, damages, or losses arising from interactions between users and has no obligation to become involved.
14. Limitation of Liability
- To the fullest extent permitted by applicable law, Waverii and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill, even if Waverii has been advised of the possibility of such damages.
- Waverii does not provide, operate, or control any services listed on the platform. All services are provided by independent third-party providers, and users participate at their own risk.
- Waverii’s total liability, if any, arising out of or relating to the use of the platform shall not exceed the amount paid by the user, if any, to access the platform.
- This limitation applies regardless of the legal theory, whether in contract, tort (including negligence), strict liability, or otherwise, and to the maximum extent permitted by applicable law.
15. Indemnification
Users agree to defend, indemnify, and hold harmless Waverii, its affiliates, employees, and agents from any claims, damages, liabilities, or expenses arising from:
- Use of the platform
- Services offered or received
- Violations of these Terms or applicable laws
- Interactions or disputes with other users
16. Termination
- Waverii reserves the right to suspend or terminate user accounts at any time for any reason, including violations of these Terms.
- Terminated users may lose access to the Platform and previously booked services. Users remain responsible for outstanding obligations or disputes.
- Waverii shall not be liable for any losses resulting from account suspension or termination.
17. Compliance with Laws & Anti-Corruption
- Users must comply with all applicable laws, including anti-bribery, anti-corruption, export control, and sanction laws.
- Users shall not use the Platform to engage in illegal activities or trade with restricted countries.
18. Consumer Rights & Severability
- These Terms do not affect Users’ mandatory rights under applicable consumer protection laws.
- If any provision of these Terms is found invalid or unenforceable under any jurisdiction, the remaining provisions shall remain in full force and effect.

20. Governing Law & Jurisdiction
- These Terms shall be governed by the laws of the State of Florida, to the fullest extent permitted by law.
- Except as provided in Section 11 regarding arbitration, Users consent to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, Florida.
